Welcome to A Bite Away.

These Terms of Service (“Terms”) govern your access to and use of the A Bite Away mobile application, website, and related services (collectively, the “Platform”).

A Bite Away LLC (“A Bite Away,” “we,” “us,” or “our”) provides a technology platform that connects individuals and, in the future, potentially businesses and organizations that wish to share food within their communities.

By accessing or using A Bite Away, you agree to these Terms. If you do not agree with these Terms, you may not use the Platform.

You must be at least 18 years old to use A Bite Away.

By using the Platform, you represent that:

• You are at least 18 years old.
• You have the legal ability to enter into these Terms.
• The information you provide is accurate and truthful.

A Bite Away allows users to create food listings and connect with other users who may wish to receive available food items.

A Bite Away is a technology platform that connects users. A Bite Away does not:

• Prepare food
• Cook food
• Package food
• Store food
• Inspect food
• Verify food safety
• Guarantee the quality, freshness, ingredients, or condition of any food shared through the Platform

Food exchanges occur directly between users.

Users may share food items including, but not limited to:

• Homemade food
• Takeout or restaurant food
• Garden-grown items
• Pantry staples
• Other permitted food items

Users are responsible for ensuring that food they share is accurately described and shared responsibly.

By using A Bite Away, users agree that they are responsible for:

• Providing accurate information about food listings.
• Providing allergen information when requested during the listing process.
• Sharing food they reasonably believe is safe for consumption.
• Disclosing known ingredients or relevant food details.
• Making their own decisions about accepting and consuming food.

Users understand that A Bite Away does not independently verify information provided by users.

Sharing and consuming food from another person or entity involves risks, including, but not limited to:

• Foodborne illness
• Allergic reactions
• Contamination
• Improper storage
• Food spoilage
• Ingredient-related risks

Users acknowledge and accept that they participate in food exchanges at their own risk.

To the fullest extent permitted by applicable law, A Bite Away is not responsible for illness, injury, allergic reactions, damages, or other issues resulting from food shared through the Platform.

Users are responsible for deciding whether food is appropriate for themselves or others.

Users may not list, share, or distribute items that are:

• Illegal
• Unsafe
• Recalled products
• Known to be spoiled or unsafe
• Intentionally contaminated
• Prohibited under applicable laws

A Bite Away reserves the right to remove any listing that violates these Terms or creates safety concerns.

Users may be required to provide information including, but not limited to:

• Name
• Phone number
• Address
• ZIP code
• Other account information necessary to use the Platform

Users agree to provide accurate information and keep their account information updated.

The collection and use of personal information are described in the A Bite Away Privacy Policy.

A Bite Away may use location information, including, but not limited to, ZIP code or address information, to help determine service-area eligibility and connect users with nearby listings.

A Bite Away does not currently collect precise GPS location from a user’s device.

A Bite Away may introduce additional location-based features in the future. Any such features may be subject to additional disclosures, settings, or permissions as required by applicable law.

Additional details regarding data collection and use are explained in the A Bite Away Privacy Policy.

Users may submit content including, but not limited to:

• Food photos
• Listing descriptions
• Food details
• Allergen or ingredient information
• Messages or communications
• Other information posted through the Platform

Users retain ownership of content they submit.

By submitting content to A Bite Away, users grant A Bite Away a worldwide, non-exclusive, royalty-free license to use, display, reproduce, distribute, and process that content as necessary to:

• Operate the Platform
• Improve the Platform
• Display listings to users
• Promote and market A Bite Away
• Maintain safety and moderation
• Comply with applicable laws

Users represent that they have the right to submit the content they provide.

A Bite Away may provide messaging features that allow users to communicate.

Users agree not to use the Platform for:

• Harassment
• Threats
• Fraud
• Illegal activity
• Abuse
• Harmful conduct
• Any other conduct prohibited by applicable law

Users are responsible for their own communications and interactions with other users.

A Bite Away provides tools that allow users to report listings or other users.

A Bite Away may review reports and may:

• Remove listings
• Restrict accounts
• Suspend accounts
• Terminate accounts
• Take other reasonable actions to protect the Platform and its users

A Bite Away does not guarantee that all harmful activity, unsafe listings, or violations will be identified.

A Bite Away currently supports individual users.

In the future, A Bite Away may allow businesses, restaurants, grocery stores, nonprofits, organizations, or other entities to participate.

Business users may be subject to additional requirements or terms.

Businesses and organizations remain responsible for:

• Their listings
• Their food practices
• Their legal compliance
• The accuracy of information they provide
• Any permits, licenses, or other requirements applicable to their activities

Food exchanges between users are intended to remain free.

A Bite Away may offer optional paid features, subscriptions, premium services, business services, or other features in the future.

Any future paid features or services may be subject to additional terms, pricing, disclosures, or agreements.

To the fullest extent permitted by applicable law, A Bite Away LLC is not responsible for:

• Food shared through the Platform
• The actions of users
• User communications
• Food-related illness or injury
• Allergic reactions
• Disputes between users
• Losses resulting from interactions between users
• Other losses or damages arising from user-to-user interactions or exchanges

A Bite Away provides a platform for connection only and does not assume responsibility for transactions, exchanges, or interactions between users.

Nothing in these Terms is intended to exclude or limit any liability that cannot legally be excluded or limited under applicable law.

Users agree to defend, indemnify, and hold harmless A Bite Away LLC, its owners, employees, affiliates, and representatives from claims, damages, losses, liabilities, and expenses arising from:

• Their use of the Platform
• Their food listings
• Their communications
• Their interactions with other users
• Their violation of these Terms
• Their violation of applicable laws or regulations

Users are responsible for complying with all applicable federal, state, local, territorial, and other applicable laws and regulations related to their use of A Bite Away.

Users are responsible for understanding and following any laws that apply to food sharing activities in their location.

A Bite Away may restrict or modify access to certain features or service areas when necessary to comply with applicable laws or regulations.

A Bite Away, including its name, branding, designs, features, software, content, and materials, is owned by A Bite Away LLC or its licensors.

Users may not copy, modify, distribute, reproduce, sell, or use A Bite Away intellectual property without permission, except as permitted by applicable law.

A Bite Away may suspend or terminate accounts or remove content if users:

• Violate these Terms
• Misuse the Platform
• Create safety concerns
• Provide false information
• Engage in harmful behavior
• Violate applicable laws or regulations

A Bite Away may also take action when reasonably necessary to protect users, the Platform, or the public.

A Bite Away may update these Terms from time to time as the Platform, its features, or applicable laws change.

When changes are made, A Bite Away may update the Effective Date and, where required by applicable law, provide additional notice.

Continued use of the Platform after updates become effective means you accept the revised Terms, to the extent permitted by applicable law.

A Bite Away may initially operate in selected geographic areas and may expand to additional locations throughout the United States and its territories.

Availability of the Platform, listings, and specific features may vary by location.

Users are responsible for complying with applicable laws and regulations in the location where they use the Platform.
